What is a cease and desist letter?

A cease and desist letter is a formal written demand asking a person or business to stop (“cease”) an activity and not start it again (“desist”). It explains what they’re doing wrong, what rights it affects, and what will happen if they don’t stop. It isn’t a court order, but it puts the other side on notice and is often enough to resolve the problem without a lawsuit.

This cease and desist letter template gives you a clear, professional structure that’s firm without being aggressive.

When to send a cease and desist letter

  • Trademark infringement: someone is using your business name or logo.
  • Copyright infringement: someone has copied your photos, text, designs or software.
  • Harassment: repeated unwanted contact or behavior.
  • Defamation: false statements damaging your reputation.
  • Breach of contract: such as a former employee breaking a non-compete or NDA.

What to include in a cease and desist letter

  • Your name or business and contact details.
  • The date and the recipient’s name and address.
  • A clear subject line describing the issue.
  • What the recipient is doing, with dates and examples.
  • Your rights, such as a registered trademark or copyright, and how they’re being affected.

  • What you may do if they don’t comply.
  • A statement reserving your rights, and your signature.

How to write a cease and desist letter

1. Gather evidence first

Take screenshots, save links, and note dates. You’ll describe them in the letter and may need them later.

2. Be specific and factual

Describe exactly what happened, without insults or exaggeration. A calm, factual tone is more persuasive and protects you if the letter is shown to a court.

3. State clear demands and a deadline

List the actions you want, such as removing content and confirming in writing, with a reasonable deadline:

“Immediately stop using the name ‘Greenleaf Coffee’, remove it from your website and social media, and confirm in writing within 14 days.”

4. Send it in a way you can prove

Use certified mail with return receipt, and email a copy. Keep a copy for your records.

What happens after you send it?

Many recipients comply, especially in clear infringement cases. Others may reply with their side of the story or propose a compromise. If they ignore the letter, you can decide whether to take further steps, such as filing a complaint with a platform, sending a DMCA takedown notice, or speaking with a lawyer about legal action. Avoid making threats you’re not prepared to follow through on.
